I know my spouse has been
hiding money or at least spending too much money up until the divorce was filed.
Do I have to prove it?
Yes. However, it can be done in two ways. Bearden Investigative Agency, Inc. can
either find the hidden funds or, if you can document the original existence of
the money and the now missing funds, the court may simply assume that the funds
were taken for use by your spouse and they will credit that amount as though they
had given that amount to him. Very frankly, this sometimes results in a windfall
for the victimized spouse particularly where the spouse hiding the money has not
saved it. However, don't become confused. Either spouse of the marriage has the
right to spend community property funds. It is only when they are overtly trying
to hide them from the court that the court will take action. You may not have
agreed with your spouse's expenditures, but unless it is egregious or there is
a current tangible benefit accrued from the funds, (car, boat, etc.) the court
is not likely to consider routine expenditures in division of the property.
