My husband is a hard-charging
professional. He says if I fight him, he won't give me anything and will leave
me destitute and take my children. Can he?
No. This is a common position of the abusive husband often typified by the very
successful aggressive professional. Texas is a very spouse-friendly state and
your spouse need not give you anything, you should simply take what the law says
is yours. BIA., attorneys, and the courts deal every day with the threatening,
abusive and egotistical spouse. Frankly, at BIA we like to help whittle them down
to size. Certain professions are recognized for routinely generating this type
of litigant - medicine, law, airline pilots, politicians and business owners often
are seen as endemic bullies.
That is OK. Understand that from the moment a divorce is filed, the court and
your lawyer are going to control the action. Even the biggest bully's threats
can be controlled, mitigated and reversed by a judge. It is simple, the bully
will do what the court says or he will ultimately pay. The bully may win some
early battles but if handled properly, we can turn the bully's perceived strengths
into actual weaknesses. Think about it, would you be inclined to help a bully?
Neither will be the court.
The key again is document, document, document all of your adversary's behavior.
Use your adversary's behavior against him.
Next, hire a good lawyer. Family Law is almost totally controlled by the
Family Code and while all lawyers can file divorces, we strongly recommend attorneys
who have a heavy Family Law case load. See our professional referral page for
attorneys in your area. The attorney can assist you in deciding whether to hire
Bearden Investigative Agency, Inc. to further document the bully's behavior for
the courts perusal.
